Dept. of Caturaf Resources <br />This letter is in response to your letter of January 5, <br />1979 and your phone call of January 15, 1979, and addresses <br />the matters set forth in your letter and those discussed by <br />phone and at our meeting of January 5th. We ask that this <br />letter be made part of the application herein. <br />1. I believe most questions raised by Great Western <br />Sugar were resolved at our meeting of January 5, 1979, particu- <br />larly those relating toixespassing and the presence of wildlife <br />on the Kauffman property, even though these are not really <br />reclamation questions. As to Great Western's concerns as to the <br />existence of their dike and possible pollution of the future <br />ponds, we had hoped to meet with Great Western's representatives <br />at the site this week. However, as I indicated to you by phone, <br />Great Western's people will not be available until 9:30 A.M. <br />on January 22, 1979. I trust we will resolve matters at that <br />time. If not, I would reiterate some points made at our <br />January 5th meeting: <br />(1). Hundreds of wildlife already utilize both <br />the Great western ponds and the Kauffman property. <br />At times in the winter the Great Western water is <br />the only available open water and the wildlife do <br />not seem to suffer; <br />(2). Regardless, the Kauffman property has been <br />used for gravel extraction for 20-25 years while <br />the Great Piestern lime pit has been in existence <br />for only approximately 8 years. Great Western has <br />no right to rely on the Kauffman property to purify <br />water seeping from Great Western lands; <br />
