At the request of Rick Mills of the Board <br />staff I have discussed the concerns expressed in their <br />letta=_r with the Division of Water Resources. <br />The letter was written by Hal Simpson of the Divi- <br />sion. On January 10, 1979 I talked to him by telephone. <br />I indicated to Mr. Simpson that Jake Kauffman and Son, Inc., <br />the applicant, is aware that there may be a legal require- <br />ment that water loss, if any, resulting from their operations <br />or reclaiming of the land, (f or example, from evaporation) <br />will have to be replaced. If this is legally required, the <br />applicant will take action to meet its legal obligations. <br />There are presently water rights connected with this property <br />which would be available to provide replacement water if <br />needed. Mr. Simpson indicated that this acknocaledgement, <br />from the applicant, would satisfy the Division's concerns at <br />this juncture with the understanding that the Division may <br />take action at some future point if not satisfied the legal <br />obligations of applicant are being met. <br />Please contact me if you have questions. <br />Very truly yours, <br />Roger E.
