It seems quite unlikely that any seepage <br />would enter the Kauffman ponds anyway since the <br />Great Western dike is approximately ten feet north <br />of a ditch separating the two properties. This <br />ditch is approximately twenty feet wide and seven <br />feet deep and mining, will take place on the Kauffman <br />property to no more than twelve foot depths, and <br />usually to only ten foot depths. Moreover, the <br />Kauffmans will only mine within approximately thirty <br />feet of the property line, anyway. Regardless if <br />the dike is some kind of hazard, it is Great Western's <br />responsibility to keep it from polluting neighboring <br />properties and to protect neighboring properties <br />from any hazard caused by the existence of the <br />structure. <br />2. Accompanying this letter are new maps which cover <br />the concerns of your paragraph #2. The permit area is delineated <br />by the solid red line on the reclamation map. Extraction will <br />take place within the enclosed area. The surveyor has estimated <br />that approximately 69 acres are included in that area. As we <br />discussed, and as you suggested, the area will be reclaimed in <br />smaller ponds rather than large lakes as depicted on a previous <br />set of maps. One other matter should be noted here. As the <br />Kauffmans indicated to you, they will mine to within approxi- <br />mately thirty feet of their property line although the areas of <br />extraction noted on the maps, at certain points, may be farther <br />from the property line than this. <br />3. As we discussed, the applicant may, as an alternative <br />plan, reclaim a portion of the western part of the affected area <br />(not exceeding 250 feet of the western portion of the property) <br />as a commercial site or otherwise develop it consistent with <br />applicable zoning and building regulations. This 250 foot portion <br />is delineated on the reclamation map with a dotted red line. If <br />so reclaimed, the area will be filled and graded to a slope of <br />approximately 5:1 or such more gradual slope as may be required <br />for construction and to meet applicable regulations. <br />4. At your request, we will include sand dropseed (.5 lb/ <br />acre) and alkali sacaton (2 lbs/acre) into the grass seed mixture. <br />Also, as agreed, american plum and sumac will be planted at appro- <br />priate locations on the reclaimed land. Since we felt there was <br />a substantial margin of error to the plus side in our reclamation <br />cost estimate, we do not feel this should significantly increase <br />the estimated cost of reclamation. <br />
