Rule 6.4.7 Exhibit G- Water Information <br />16. Please explain how surface will be managed to protect against pollution of surface of <br />groundwater both during and after the mining operation (Rule 6.4.7(2)(c)). <br />17. Please identify and name all ditches on and within 200 feet of the affected land. Please <br />locate these ditches on the appropriate maps and further explain the ownership of the ditches. <br />If any ditches aze to carry water or aze relocated as a result of the mining operation, please <br />submit a written consent from the owner of the ditch. <br />18. The Division received comments from the Office of the State Engineer (OSE). The OSE <br />states that the applicant has not identified any proposed use of water at the permit site. If <br />water will be used for any purpose at the site, the applicant will need to document that the <br />water was obtained from a legal source, or the water was diverted in priority under a water <br />right decreed for such industrial use. <br />19. The OSE letter also states that if stormwater runoff is intercepted by this operation and is not <br />diverted or captured in priority, it must be released to the stream system within 72 hours. <br />This may require a permit from the CDPHE-WQCD. Otherwise, the applicant will need to <br />make replacements for evaporation. Please address accordingly. <br />Rule 6.4.9 Exhibit I- Soils Information <br />20. The applicant provided a soils map in the permit application. Please indicate on the soils <br />map the location of the proposed Schumacher Pit #3. The location is important in order to <br />determine the soil type and chazacteristics. <br />Rule 6.4.12 Exhibit L- Reclamation Costs <br />21. The Division will estimate a cost to reclaim the site based on the information submitted in the <br />application. <br />Rule 6.4.19 Exhibit S- Permanent Man-Made Stmctures <br />22. Please be awaze if the applicant encroaches into any easements as a result of the mining and <br />operation plan, then the applicant must obtain legal right of entry document from the <br />easement holder. Please state what easements will be included, and provide legal right of <br />entry agreements. <br />23. The Division reviewed the Schumacher Gravel Pit operated by Logan County Road and <br />Bridge (Permit No. M-1995-063). On the most recent annual report, it appears that a pipeline <br />is running along the southern boazder of the Schumacher Pit #3. Attached is a copy of the <br />map from the file. Please identify the pipeline on the exhibits, state the owner of the <br />pipeline, and describe how close mining will take place to the structure. If the pipeline is <br />within 200 feet of the affected azea, the requirements of Rule 6.4.19 must be addressed (see <br />below for further detail). <br />24. The applicant states that there aze wind generator towers and power lines with 200 feet of the <br />pit boundaries and that they will provide notice at the same time notice is provided to the <br />adjoining landowners.
