just notice of the permit application. In particular, Rule 6.4. I9 states that if a structure is <br />within 200 feet of the affected land, the applicant may either; <br />a- provide a notarized agreement between the applicant and the person(s) having an interest <br />in the structure, that the applicant is to provide compensation for any damage to the <br />structure, or <br />b. where such an agreement cannot be reached, the applicant shall provide an appropriate <br />engineering evaluation that demonstrates that such structure shall not be damaged by <br />activities occurring a the mining operation, or <br />c. where such structure is a utility, the Applicant may supply a notarized letter on utility <br />letterhead, from the owners(s) of the utility that the mining and reclamation activities will <br />have "no negative effect" on their utility. <br />Please provide one of the following items noted above for all structures within 200 feet of the <br />affected land (i.e. roads, fences, utility lines, gas pipelines, wind turbines, wells, ditches, <br />structures associated with the Horizon Pork Facilities, etc...). <br />Under Rule 3.2(7) the Division is required to conduct an inspection prior to Board consideration. <br />The Division will schedule an inspection prior to the decision date. Additional questions may <br />arise as a result of the inspection. In addition, the Division will forwazd any comments received <br />during the public comment period from other agencies or concerned citizens. <br />Please be advised that Schumacher Pit #3 New 112 Application maybe deemed inadequate, and <br />the application maybe denied on January 2, 2007 unless the above-mentioned adequacy review <br />items are addressed to the satisfaction of the Division. If you feel more time is needed to <br />complete your reply, the Division can grant an extension to the decision date. This will be done <br />upon receipt of a written waiver of your right to a decision by January 2, 2007 and request for <br />additional time.
