<br />3.1.3 Time Limit and Phased Reclamatio^ <br />The applicant will carry reclamation to completion with all reasonable diligence. No phasing as such <br />is proposed. Reclamation will be an ongoing procedure following mining and processing as closely <br />as operationally feasible. Mining will start on the east and move southwest until complete. ,j <br />3.1.4 Public Use <br />Neither the applicant or Lessor plan on opening the subject to public use. Such interference is not <br />needed on private farm, ranch, dairy and mining uses. <br />3.1.5 Reclamation Measures -Material Handling <br />(1) Grading shall be carried on so as to create final topography appropriate to the final land ,/ <br />use selected as the Reclamatiou Plan. <br />(2) When backfilling is part of the plan ......................... <br />No backfilling is proposed as the pit floor will daylight on most of the perimeters eliminating any <br />need for back filling. Any backsloping will be an integral part of the mining plan and there will be <br />no excavations that will require backfilling. There are no acid-forming or toxic materials that could <br />be leached. <br />(3) All grading will be done in a manner to control erosion and siltation of the affected lands <br />to protect areas outside the affected lands from slides and other damage: If not eliminated, all <br />highwalls, if any, shall be stabilized. <br />There will be no highwalls or potential slide areas in this operation. <br />(4) All backfilling and grading shall be completed as soon as feasible after the mining process. <br />The applicant shall establish reasonable timetables consistent with good mining practices and <br />reclamation procedures. <br />As stated earlier, there will be no backfilling. Grading will be performed as reasonably consistent <br />with mining, stockpiling and equipment movement. Reclamation will follow mining as closely as <br />operationally feasible. <br />(5) There are no refuse, acid-forming or toxic materials that will be mined or handled on site <br />that could cause unsightliness or affect the drainage system. <br />(6) There are no drill or auger holes involved in this operation to be plugged to prevent <br />pollution drainage.
