operating on the Leased Premises as an independent contractor -- <br />• and that all persons must look solely to Lessee for payment <br />for any labor or material supplied to Lessee's order on the <br />Leased Premises. Lessee shaall promptly pay for materials <br />and labor so supplied on the Leased Premises and shall keep <br />the Leased Premises free and clear of all liens and <br />encumbrances for such materials and labor. <br />5.5 Workman's Compensation. Lessee shall comply with <br />the terms and provisions of the Workman's Compensation laws <br />of the State of Colorado and all other applicable State and <br />Federal rules and regulations. <br />ARTICLE VI <br />RECLAMATION <br />6.1 Lessee agrees that upon completion of its surface <br />mining operations on the Leased Premises it will perform such <br />work and do such acts as may be validly required by the terms <br />of its surface mining permit and by the provisions of state <br />• and federal laws and lawful regulations promulgated <br />thereunder, including but not limited to laws pertaining to <br />strip mining and mined lands reclamation to the extent that <br />such laws and regulations cover and apply to, the operations <br />conducted by Lessee on the Leased Premises. Lessee shall <br />remain responsible for the performance of the obligations <br />imposed by this Article despite the termination of this Lease <br />and agrees with Lessor that Lessee will proceed with <br />reasonable promptness and diligence to carry out and complete <br />the work and acts validly required by said laws and <br />regulations. <br />ARTICLE VII <br />REPRESENTATIONS. WARRANTIES AND COVENANTS OF LESSEE <br />7.1 Lessee is not a party to, subject to or bound by <br />any mortgage, deed of trust, loan agreement, contract or <br />other agreement of any kind, or any judgment, order, writ, <br />injuction, or decree of any court or governmental agency <br />which could prohibit, prevent, or affect the carrying out of <br />the transactions contemplated by this Lease or the <br />7 <br />
