• operations hereunder, notwithstanding any such compliance or <br />lack of same. Nothing contained in this Section shall <br />prevent Lessee from contesting the applicability or validity <br />of any law, regulation or administrative ruling or order <br />which Lessee, in good faith, believes to be invalid or <br />inapplicable to its operations and activities under this <br />Lease. <br />5.2 Indemnification. Lessee will indemnify and save <br />Lessor harmless from any and all loss or liability for <br />claims, demands, suits or causes of action for damages and <br />injuries (including death) of every kind and nature to <br />persons and property, including without limitation, roads, <br />railroads, pipelines, structures, and improvements, caused or <br />claimed to have been caused by Lessee in it operations <br />hereunder, whether based upon negligence, deliberate act or <br />omission of Lessee, and Lessee will defend all such claims,. <br />demands and suits at its sole cost and expense. Lessee <br />• further covenants and agrees to indemnify, save harmless and <br />defend Lessor from any and all loss, liability or damages <br />arising out of or in any manner related to any breach of <br />covenant, condition or act of default by Lessee under this <br />Lease. Nothing herein shall relieve Lessor from liability <br />for its own negligence or acts, or the negligence or acts of <br />its employees, agents, contractors, successors or assigns., <br />5.3 Insurance. Lessee agrees to obtain and, during the <br />term of this Leaaee, to maintain in force personal injury and <br />property damage liability insurance, covering the operations <br />of Lessee hereunder which insurance shall be placed with a <br />reputable insurance company qualified to do business in <br />Colorado with limits set forth by Colorado Mined Land <br />Reclamation Soard, Regulation N. 2.03.9, Lessee agrees to <br />furnish Lessor with certificates of such insurance. <br />5.4 Independent Contractor. Lessee shall post <br />conspicuous notices on the Leased Premises conforming with <br />• all applicable Colorado Statutes advising that Lessee is <br />operating on the Leased Premises as an independent contractor <br />and that all persons must look solely to Lessee for payment <br />6 <br />
