• coal sale, such questions shall be submitted to arbitration
in accordance with the rules of the American Arbitration
Association for determination as set Yorth in Article XIII
below.
3.6 Disbursements. All payments required under this
Lease shall be paid directly to Lessor at the address listed
above or at such other address as directed, in writing, by
Lessor.
ARTICLE IV
ESSER INTERE
4.1 Lesser Interests. If Lessor owns an interest in
the Coal underlying the Leased Premises less than the entire
and undivided Coal estate therein, then the Annual Minimum
Royalty and Production Royalty shall be due Lessor only in
the proportion that its interests bears to the whole and
undivided Coal estate. Such Annual Minimum Royalty shall be
increased on the next Anniversary Date after the acquisition
of any reversionary interest or after-acquired title to
• reflect the interest so acquired, and Lessor agrees to notify
Lessee in writing upon acquisition of any additional interest
in the Leased Premises, whether by reversion or
after-acquired title. IY such additional acquisition occurs
after production is obtained, then the Production Royalty
shall be increased to reflect the interest so acquired. (See
Addendum A attached, if applicable.)
ARTICLE V
MANNER OF MINING
5.1 Permits. Licenses. Etc. Lessee agrees to~obtain
and keep in force all permits, licenses, certificates,
approvals or other permissions as may be legally required for
it to engage lawfully in the operations hereunder. Lessee
shall conduct its operations in a careful and minerlike
manner and shall comply with all laws, rules and regulations
of federal, state and local governments which may pex~ain to
• the operations contemplated by this Lease; provided however,
that Lessee shall indemnify and hold harmless Lessor from all
liabilities which may arise from the conduct of its
