= Division's experience that over time such structures will eventually be plugged by fines <br />and water is no longer able to seep through the embankment. Given this scenario, the <br />operator may be required to construct a spillway. <br />• If the sump is constructed to a depth of 3 feet, will groundwater be exposed? <br />• How will the water below the embankment l,in the incised area) be discharged within 72 <br />hours? <br />5. Exhibit C-2 depicts the location of the topsoil pile(s) along [he north and west fringes of the <br />permit area. Please inform the Division how the topsoil piles} will be protected from the mining <br />operation. The pit will be mined to a depth of 60 feat at a O.Shav slope. Please specify a buffer <br />that will be maintained from the top edge of the pit and the base of the topsoil pile{s) to ensure <br />that topsoil is not lost to the pit. <br />Rule 6.4.5 Exhibit E- Reclamation Plan <br />6. Please further explain the reclamation plan for the sediment sump and berms proposed on site. <br />7. The applicant proposes a seed mixture containing Pubescent Wheatgrass, Smooth Brome and <br />Yellow Sweetclover. The seed mixture in the existing Fetcher Ranch Pit (Permit No. M-1983- <br />134) contains a mixture recommended by the Division in 1983 including the following: <br />• Western Wheatgrass 5.5 PLS <br />- : .. • ..Mountain Brome 2.5 PLS <br />•., Bluebunch Wheatgrass 4.5 PLS <br />• Winterfat 1.5 PLS <br />- • .Alfalfa 0.5 PLS <br />- Total 14.6 PLS/ACRI; <br />Please explain to the Division why the applicant intends to change the seed mixture to something <br />less diverse than what was approved in 1983, If the landowner prefers this seed mixture, please <br />provide a certified letter from the landowner requesting this mixture in the reclamation plan. <br />8. The applicant states that the staging area will be used as an agricultural storage activity. The site <br />will be graded and covered with 4 to 6 inches of gravel, but will not be topsoiled or revegetated. <br />In order for the Division to approve this portion of the reclamation plan, the applicant will need <br />to submit'a certified letter from the landowner concurring to this reclamation plan. Tn addition, <br />please further explain the structures that will be removed from site (i.e. diesel fuel tanks, berm, <br />etc..) and the structures that will remain on site. <br />Rule 6.4.7 Exhibit G- Water Information <br />The applicant states that water is used on site when necessary to control dust, and the water <br />supply for these uses comes from an existing irrigation ditch located near the permit boundary. <br />Please provide an estimate of the project water requirements including flow rates and annual <br />volumes fro the development, mining and reclamztion phases of the project as required by Rule <br />6.4.7(3). In addition, please specify the source of the water rights obtained by Elam <br />Construction, Inc. to supply the project water requirements for the mining operation and <br />reclamation. <br />
