Cattany <br />Acing Division Director <br />Listed below are adequacy review comments on the Fetcher Gravel Pit New 112 Application; Permit <br />Number M-2002-119. The Division of Minerals and Geology (Division) is required to make. an <br />approval or denial decision no later than March 26, 2003, therefore, your response to the following... . <br />adequacy review cnncerns should be submitted to the :Division as soon as possible. <br />1: As required by Rule 1.6.2 (1)(g), please submit thf; proof of publication of the'public notice <br />circulated in the local newspaper, all owners of record of surface lands, easement holderc_, and <br />owners of record of surface lands that are within 200 feet of the boundary of the. affected land. <br />Proof of notice may be return receipts of a Certifie d Mailing or by proof of personal service;. <br />Rule 6.4.4 Exhibit D- Mining Plan <br />2. The applicant states that if water is encountered, e:ccavation will stop and the azea will be <br />backfilled to cover the water. Please commit to covering any exposed groundwater with two feet <br />of overburden material. <br />The applicant states that a portable asphalt plant may be erected on the site from time to time. <br />Please depict the location of the plant and associated structures on the Mine Plan Map, and <br />include a plan to ensure the surface water and groundwater systems will not be impacted by such <br />operations. <br />4. The operator plans to construct a sediment sump to trap all runoff from the 100 yeaz 24 hour <br />event. The applicant states that the pond will be primarily incised, however, it is also stated that <br />the dam will be less than 6 feet high and will have 2h: lv side slopes and water will seep through <br />the embankment within 72 hours. Please be aware. that the Division does not require total <br />containment of the 100 year 24 hour storm event. Typically check dams or smaller sumps are <br />more than adequate to ensure that sediment is retained on the site. However, if the operator <br />intends to construct this structure the following information must be submitted: <br />• Please provide a more detailed map illustrating this impoundment structure including <br />proposed slopes on the dam and the interior of the pond. <br />• Please provide the calculation used to determine that water will seep through the <br />embankment within 72 hours and a gradation of the material to be used.
