S WMP Availability (continued) <br />All SWMPs required under this pemnt are considered reports that shall be available [o the public under Section 308(b) of the <br />CWA. The owner or operator of a facility with stormwater discharges covered by ties pemut shall make pians available to <br />members of the ppublic upon reqguest, unless the SWMP has been submitted to the Division. However, the perznittee may claim <br />any portion of a SWMP as conTldennal m accordance with 40 CFR part 2. <br />g. Annual Report <br />The permittee will be required to submit an Annual Report, covering Ianuary 1 through December 31 of each year, on the <br />overall compliance with the SWMP. The Annual Report shall contain, at a rmnunum: <br />i) Name of pemtittee, address, phone number, and permit certification number. <br />it) A report on the facility's overall compliance with the SWMP, including a progress report on all remediarion activities. <br />iit) A sumtnary of each comprehensive stormwater facility inspection made, including date, findings, and action taken. <br />iv) Results and interpretation of any stormwater monitonn pperforated. <br />v) Certification language and signature by the perrnittee. See Part LD.E.2 of the permit.) <br />The re ort will be due to the Division on or before February 15 of the following year. The exact due date for the pennittee's first <br />Annual Report will be listed in their pemut rationale. Terminafion of Stotmwater Permit Coveraee Requirement <br />i) Termination Criteria <br />a) Reclamation Permit Release: When a site has been reclaimed in accordance with the Colorado Division of Minerals <br />and Geology (CDMG) requirements and the site has been released from State reclamation requirements, the permittee <br />may request temtination of the stormwater coverage under this pemtit. <br />ii) Request for Tetminarion <br />When a site has been reclaimed in accordance with the CDMG requirements and the site has been released from State <br />reclamation requirements, the permittee may request termination of stotmwater coverage under this permit. The Division <br />will consider termination of stormwater coverage when: <br />a) the pennittee has submitted a completed Inactivation Form as provided by the Division which summarizes the work <br />accomplished; <br />b AI[ stormwater discharges to state waters associated with mining activities have ceased and the CDMG performance <br />bond has been released; <br />d) The Division fords that the ppermittee has shown reasonable grounds consistent with the Federa] and State statutes and <br />regulations for such temainahon; and <br />e) Foe reoutzements of Section 61.15 of the State Dischazge Permit System Regulations have been met. <br />Continued coverage maybe required after reclamation or remediation has been completed if the Division has shown or has <br />zeason to suspect that the stonnwater dischazge may contribute to a violation of a water quality standard. <br />i. Storrrrwater Definitions <br />a. Best management practices (BMPs): schedules of activities, prohibitions of practices, maintenance procedwes, and other <br />management practices to prevent or reduce the pollution of waters of the State. BMPs also include treatment, operating <br />procedwes, and pracnces to control site runoff, spillage or leaks, waste disposal, or drainage from material storage. BMPs <br />include structwal and nonstructural controls. <br />b. Operator: the individual who has day-to-day supervision and control of activities occurring at the mine site. <br />c. Remediation, as used in this permit, means actions taken to reduce or eliminate the overall advezse environmental itripact <br />associated with a pollutant sowce. The term includes actions such as re-routing of surface flows, re-location or a pollutant <br />sowce, the addition of pollutant neutralizing or immobilizing substances, capping and re-vegetation. <br />d. SigntScant Materials include but azc not limited to: raw materials; fuels; materials such as metallic products; hazardous <br />substances designated under section 101(14) of CERCLA; fertilizers; pesticides; and waste products such as ashes, slag and <br />sludge that have the potential to be released with stormwater dischazge. <br />E. GENERAL MONITORING, SAMPLING, AND REPORTING REQUIItEMENTS <br />1. Routine Reportine of Data <br />Reporting of the data gathered in compliance with Part LB.1 shall be on a montlily basis. Reporting of all data gathered shall comply <br />with the requirements of Part LE. (General Requirements). Monitoring results shall be suzrmtarized for each month and reported on <br />Division approved dischazge moni{oring report (DMR) forms (EPA form 3320-I). The fomvs shall be mailed to the agenc>..es listed <br />below so they aze received no later than the 28th day of the following month.
