PARTI <br />Page No. 14 <br />Permit No.: CO-0035776 <br />yi) Consistency with Other Plans <br />SWMPs may reflect requirements for S ill Prevention Control and Countermeasure ((SPCC) plans under section 311 of the <br />CWA, or Best Management Practices ~BMPs) Programs otherwise required by a CDPS penmt, and may incorporate any <br />part of such plans into the SWMP by reference. The SWMP ma reflect information contained in approved plans <br />submitted for other similar ppollution control programs, including the Voluntary Clean Up Program (Voluntary Cleanup and <br />Redevelopment Act, CRS 25-16-303) as long as they contain the elements described above. These plans must have been <br />approved by the implementing agency riot to application for the Stormwater Pemut. Appropriate portions of these other <br />plans maybe incorporated in the SWI~ by reference, as long as a commpplete SWMP can be reproduced and submihed to the <br />regluesting agency witlriri the time frame spec>fied in the request. Those portions of the referenced documents must be <br />inc uded m the submittal. The SWMP must also be readily available to an on-site inspector, <br />b. General Limitations <br />The following limitations shall apply to all discharges authorized by this permit: <br />i) Stotmwater discharges from mining operations or mine-waste remediation projects shall not cause or threaten to cause <br />pollution, contamination or degradation of State waters. <br />ii) Bulk storage structures for petroleum products and other chemicals shall have adequate protection so as to contain all spills <br />and prevent any spilled material from entering State waters. <br />iii) No chemicals are to be added to the discharge unless pemussion for the use of a specific chemical is granted by the <br />Division. In granting the use of such clieaucals, special conditions and monitoring may be addressed by separate letter. <br />iv) All dischazgers must comply with the ]awful requirements of counties, drainage districts and other state or local agencies <br />regazding any dischazges of storrriwater [o storm drain systems or other water courses under their jurisdiction. <br />c. SWMP Requirements <br />i) SWMP Submitta]/Revi6w/Changes: The Division reserves the right to request and review the plan, and to require additional <br />measures to prevent and control pollution, as needed. Upon review of the SWMP, the Division may notify the permittee at <br />any time that the plan does not meet one of more of the minimum requirements of this permit. After sucfi notification, the <br />permittee shall make changes to the plan. Unless otherwise provided by the Division, the pemuttee shall have 30 days after <br />such notification to both make the necessary changes to the plan and to miplement them <br />The pennittee shall amend the plan whenever there is a change in design, construction, operation, or maintenance which has <br />a s'¢mficant effect on the•potenhal for the dischazge of pollutants to the waters of the State, or tf the SWMP proves to be <br />ineffective in achieving the general obT7ectives of controlling pollutants in stormwater dischazges associated with mining <br />activity. Amendments to the plan shall be summarized in the Annual Report. <br />d. Prohibition of Non-storrriwafer Discharges <br />i) Except as provided in pazagraph b, below, all dischazges authorized by the stormwater portion of this pernut shall be <br />composed entirely of stormwater. Discharges of water other than stormwater must be addressed in a separate CDPS permit <br />issued for that discharge. <br />ii) Discharges from the following sources that aze combined with storarwater dischazges associated wit4 mining activity may be <br />authorized the stormwater pportion of this pemut, provided [hat the non-stormwater component of the discharge is identified <br />in the SWMP (see Part LD.2.c of the permit): ire fighting activities, uncontaminated compressor condensate, imgation <br />drainage, lawn watering, air conditioner condensate, uncontaminated seeps and springs, and foundation or footing drains <br />where flows aze not contaminated. <br />e. Facility Inspections <br />Qualified personnel identified by the operator shall make a thorough inspection of their stoiutwater management syste at least <br />twice per yeaz (in the spring and fall}. T7iese inspections must be documented and summarized in the Annual Report see Part <br />LE.1 of the permit). <br />The inspections must include the following: <br />i) Disturbed azeas and azeas used for material storage that aze exposed to precipitation shall be inspected for evidence of, or <br />the potential for, pollutants entering the drainage system Erosion and sediment control measures identified in the SWMP <br />shall be observed to ensure that they are operating correctly. <br />ii) Based on the results of the inspection, the descripption of the potential pollutant sources and the pollution prevention and <br />control measmes that aze identified in the SWMP shall be revised as appropriate as soon as practicable after such <br />inspection. Revised control measures shall be r' lemented a timely manner, but m no case more than 90 calendaz days <br />after the inspection, unless otherwise provided by the Division. <br />iii) The operator shall keep a record of inspections, including the date of the inspection, major observations relating to the <br />implementation of the SWMP, and actions taken in accordance with paragraph 2), above. This record shall be made <br />avalable to the Division upon request and summarized in the Annual Report. <br />f. SWMPAvailability <br />Upon request the peimittee shall submit a copy of the SWMP to the Division, the Colorado Division of Minerals and Geology <br />and EPA, an~ any local agency approving sediment and erosion plans or stotmwater management plans, within the time frames <br />specified in the request. <br />Revised M192(%14 <br />
