Concerning spills of toxic, hazardous or non-hazardous <br />materials, a strict policy for servicing equipment is if force. <br />All used oils and lubricants are pumped into storage tanks on the <br />service truck. There are no plans to use toxic materials on site. <br />Hazardous materials such as diesel fuel and gasoline will be <br />limited to approved above ground storage tanks. Berms consisting <br />of overburden or rejects will be placed around the storage tanks to <br />contain any spills. In the event of a spill either the County <br />Sheriff or the State Highway Patrol will be notified so that proper <br />handling of the hazardous material occurs. <br />10. The Colorado Stormwater Regulation indicate that if you do not <br />anticipate any discharge from the operation than a Stormwater <br />Permit is not required. Mining will occur in such a manner that <br />stormwater will be retained within the permit boundaries. A copy <br />of a letter to the Colorado Department of Health concerning this <br />matter is enclosed. <br />Regarding the estimated cost of reclamation, overburden will be <br />replaced to a depth of no more than 12 inches. See the attached <br />revised Attachment 3. <br />I trust the information provided answers your concerns. A copy of <br />this letter along with the maps has been filed at the Las Animas <br />Clerk and Recorders Office. A copy of the certification from the <br />Clerk will be sent to you.
