Page 3 <br />TETRA TECH RMC Mr. Berhan Keffelew <br />July 27, 2004 <br />D) During the pre-operational inspection, the operator agreed to have the slurry <br />wall design approved by SEO and have it in place prior to any mining activity <br />taking place and post the 20% warranty to DMG. <br />The slurry wall will be designed consistent with SEO standards and it will be <br />installed prior to mining on the portion of the site that is west of the Fulton <br />Ditch. Preliminary specifications are attached. Aggregate Industries will <br />bond 20% per DMG standards. Please see the cost estimate included in item <br />VIII below. <br />IV) EXHIBIT "E"RECLAMATION PLAN <br />A) It is the understanding of the Division that the post mining land use for the <br />proposed area is a lined a reservoir and that the substitute water supply plan <br />will be approved and a copy of the approval submitted to the Division before <br />any water is exposed in the proposed permit area. <br />Your understanding is correct. <br />B) Under the soil information, bore holes indicated a range between 1 feet to 10 <br />feet, but you only committed to placing 6 inches. The Division request that you <br />commit to placing a minimum of I2 inches of overburden/ top soil over the <br />entire 28.1 acres. <br />The operator will place a minimum of 12 inches of overburden top soil over <br />the entire 28.1 acres of disturbance in Phase 3. <br />V) EXHIBIT "F"ADEQUATE <br />Noted <br />VI) EXHIBIT "G' WATER INFORMATION <br />A) Since the 100 year flood plain is with in the proposed permit area, the <br />operator must be in compliance with all the requirements of Urban Flood <br />Drainage Control. <br />The operator will be in compliance with the Urban Drainage and Flood <br />Control District Requirements. The applicant has had apre-application <br />meeting with Urban Drainage and Flood Control District and Adams County. <br />A Flood Plain Use application has been submitted to the County for this <br />project. <br />
