The horizontal alignment of the conveyor system is <br />shown on the attached Mining Plan Map. The conveyor system is an asset of <br />the applicant. It is unlikely that the DMG would be responsible for the <br />removal of the conveyor system. The value of the conveyor system would <br />more than cover the cost for removal and therefore inclusion in the <br />reclamation cost estimate is not necessary. <br />The conveyor crossing under 104`h Avenue will use the existing bridge where <br />the Bull Seep currently crosses. The bridge is an existing structure and will <br />not be removed at reclamation. <br />B) You have stated, "Fuels and lubricants stored and or used on site in <br />association with the mining operation are managed in accordance with <br />applicable state and federal regulations, including a Spill Prevention, Control <br />and Counter measures Plan (SPCC) developed and certified by a registered <br />Professional. Please provide the designs once completed and include the cost <br />to remove them in EXHIBIT "L '. <br />It is anticipated that only minimal materials, if any, to fuel and maintain <br />equipment will be stored on-site. Any fuel and/or lubricants stored on site <br />will have appropriate containment structures, as required by State and EPA <br />regulations. If the quantity stored on-site exceeds the regulatory threshold, a <br />Spill Prevention, Control and Countermeasures Plan (SPCC) will be <br />developed. <br />There will be no permanent structures associated with fuels and lubricants <br />stored and/or used on site. Fuel tanks are double-walled, portable tanks that <br />are moved among the various phases as mining progresses. Lubricants are <br />stored in a trailer, which serves as the containment structure. These portable <br />containment and storage facilities aze assets of the applicant and they will be <br />removed from the site by or on behalf of the applicant. <br />C) In the mining plan map, it is indicated that Bull Seep Ditch, is going to be <br />moved, to accommodate the mining operation. However, there is no design <br />and location submitted Please provide a map showing the new location. Does <br />the operator have an approval from the owners of the ditch for the proposed <br />move? <br />The proposed location of the Bull Seep is shown on the Mining Plan. The <br />applicant has received approval from the US Army Corps of Engineers and <br />preliminary approval from the Ditch Company. Please refer to the US Army <br />Corps of Engineers Section 404 permit, included in Exhibit M of the permit <br />application. <br />
