As coincident data becomes <br />available from the newly installed stream gages the stream depletion fac- <br />t tors can be adjusted. Due to current market conditions, scheduled mining <br />in the Minnesota Creek basin has been delayed, thus allowing additional <br />time to obtain coincidental data. We suggest that the factors be recal- <br />culated by WECC in the first year of retreat mining. If they are signifi- <br />cantly different than those presented in the plan, then an adjustment can <br />be made. <br />' Historic Return Flows <br />The amount of augmentation credit available to WECC is dependent upon the <br />' historic use of the water rights. Drawing No. 2, Ditch Diversion and <br />Return Flow Diagram, depicts the historic use pattern of the WECC water <br />rights with respect to all of the existing water rights on Minnesota Creek <br />below Dry Fork. The amount of return flow, expressed as a percent of <br />diversion, is also shown on Drawing No. 1. The amount of return flow is <br />based on consumptive use calculations and historic diversion records. <br />Table 5, Page 17, of the WWE Engineering Report has been amended to reflect <br />' the actual calculated irrigation efficiency for each ditch. A copy of the <br />amended Table 5 is attached. <br />' Augmentation Credit P.dministration <br />The Conditions of Operations of the Plan of Augmentation (paragraph i, page <br />t 24 ) states that WECC may augment the stream by by-passing to the stream <br />quantities of water set forth in Exhibit D. The water rights to be used <br />t for augmentation and the amount of historically irrigated land which can be <br />"dried up" is presented in Table 6. (Exhibit F in the Decree.) <br />During the time of a valid call, WECC shall bypass an appropriate amount of <br />water as determined by the methodology in the Plan of Augmentation, and <br />cease to irrigate the land historically irrigated by that amount of water. <br />WECC shall be entitled to augmentation credits for that quantity of water <br />by which historical irrigation practice reduced the stream flows available <br />• to the calling right. <br />
