Drill hole cuttings xill be either 1) returned <br />to the drill hole, 2) hauled to an appropriate disposal site, or 3) <br />~~ scattered evenly to a depth of one-quarter (1/9) inches or less aver the <br />disturbed area. <br />XI. LEGAL FACTORS <br />A. 7'h is contract/permit is subi2ct to the regulations found in 43 CFR <br />:600. <br />B. Upon notification by the AO or AOR all operations will cease and <br />remedies will be made for any incidents of noncompliance. <br />C. Any use of the surface or of the mineral materials involved shall be <br />done as not to endanger or materially interfere with prospecting, <br />mining, or processing operations or uses reasonable incident thereto, <br />on any valid mining claim subsequently located ott the land involved <br />herein. <br />D. This contract/permit is subject to any and all existing rights. <br />E. The operator agrees to the employment of any other operational, mining <br />and reclamation practices as prescribed by the Government which will <br />enhance and protect the environment and other public interests and <br />xhich may become prescribed after due investigation of the <br />circumstances. <br />F. Operator shall observe and comply with all federal, state and county <br />laws applicable to the operation under this contract/permit. <br />The operator xill contact all appropriate governments to make <br />necessary arrangements for permits. The following are some, but not <br />all of these agencies: <br />1. Submit complete 112 Permit to: <br />Bureau of Land Management (Also Exhibit N, Right-of-Vay, etc.) <br />Colorado Mined Land Reclamation Division <br />•i. <br />2. Some other agencies: <br />Colorado Department of Health !Exhibit N) <br />Colorado State Engineer (Valet Rights, Exhibit G, N) <br />U.S. Army Corps of Engineers (Exhibit N, 404 Permits) <br />Mining Safety and Health (Exhibit N) <br />Board of County Commissioners (Exhibit N,, N) <br />Colorado Division of Vildlife (Exhibit H) <br />U.S. Soil Conservation Service (Exhibit I, J, K, L) <br />U.S. Forest Service (Exhibit Id) <br />-16- <br />
