<br />Page 6 of 8 <br />X. OTHER RESOURCE FACTOkS <br />A. The operator and his agents assume liability for damages caused by <br />fires resulting from operations under this Free Use Permit. The <br />operator shall extinguish without expense to the Government all fires <br />on or iii the vicinity of the project set or caused by his employees <br />whether set directly or indirectly as a result of operations. The AO <br />or AOR inay prohibit exploration, drilling, or other activities during <br />severe fire danger period or when a fire prevention order is in <br />effect. <br />8. Any historical, archeological, or paleontologic finds are to be left <br />intact and reported to the Authorized Officer. Cost of any recovery <br />of such values will be borne by the operator. <br />C. Mo bla<_.ting or dozing will be permitted within one-quartet (~) mile of <br />historic trails or sites, natural areas, identified archeological or <br />paleontologic sites, and recreation areas. The operator shall, unless <br />otherw:~se relieved by the AO or AOR: <br />1. Engage the services of a qualified professional archeologist <br />to perform and submit a report of an intensive cultural <br />resources inventory on areas subject to disturbance by <br />earth moving equipment. <br />2. Avoid or mitigate impacts to cultural resources located by the <br />intensive cultural resource inventory. <br />3. Undertake additional measures requested by the AO or AOR to <br />protect cultural resources that may be affected as a result of <br />the operation. <br />D. The o>erator shall avoid any operations when the ground is muddy <br />andJor wet. The AO or AOR Officer may prohibit activities during wet <br />or heavy snow periods. <br />E. All trash, flagging, lath, oil, etc., will be removed and hauled to <br />an authorized disposal site. This includes alI oil soaked dirt and <br />rock which has resulted from leaking equipment and/or oil changes. <br />F. Water for washing or drillinq•purposes will not be obtained from <br />Federally owned or controlled water sources such as reservoirs and <br />spricigs unless specific permission is obtained from the AO or AOR; and <br />the taking is in compliance with the Water Resources Division. <br />G. Repo::t any available information concerning xater sands or artesian <br />flows to the authorized office. Information will include location, a <br />map, depth of main bearing formations, etc. <br />M. Sealing, plugging, and capping of drill holes will conform to the <br />requirements of the Colorado Mined Land Reclamation Act, as amended: <br />-15- <br />
