<br />14. REMEDIES OF OWNER In the event of any failure by the Lessee to <br />pay any rental payment or a violation of the terms of this Lease, the Owner shall give <br />Lessee 30 days written notice of such violation. If the Lessee does not cure such violation <br />of this Lease within 30-day period, the Owner shall have the right to declare this Lease <br />terminated without further notice to the Lessee and shall have the right to re-enter and <br />repossess the Leased Premises and to remove the Lessee therefrom. <br />In the event the Owner elects to re-enter and repossess the Leased Premises and to <br />terminate the Lease, the Lessee shall remain liable for any unpaid lease payment due and <br />owing to the Owner, and any damages sustained by the Owner as a result of any default by <br />the Lessee. The failure on the part of the Owner to re-enter and repossess the Leased <br />Premises, or to exercise any of their rights hereunder upon default, shall not preclude the <br />Owner from exercise of any such rights during the continuance of such default or upon <br />any subsequent default. <br />15. TAXES. The Owner shall pay when due all real property taxes upon the <br />Leased Premises. The Lessee shall be responsible for payment of any taxes upon Lessee's <br />personal property and equipment upon the Leased Premises and shall further pay when <br />due arty sales, excise, mineral severance, or other tax of any nature whatsoever upon the <br />sand, gravel, rock and fill materials removed from the Leased Premises or Lessee's <br />operations thereon. <br />16. INTEREST. Any sums owing by Lessee to Owner hereunder not paid <br />when due shall accrue interest at 12.0% per year from the due date until paid <br />17. RIGHT OF FIRST REFUSAL. In consideration of this Sand and Gravel <br />Lease, Owner hereby gives, grants and conveys to Lessee an irrevocable Right of First <br />Refusal to purchase the Leased Premises and/or the Gravel Pit -Eastern Site, the Gravel <br />Pit -North Site and the Gravel Pit -West Site now owned by the Owner under terms and <br />conditions hereafter set forth: <br />17.1 In the event the Owner receives a bona fide offer to sell the Leased <br />Premises, or the Gravel Pit -Eastern Site, or the Gravel Pit -North Site or the Gravel Pit - <br />West Site, Lessee shall have the absolute Right of First Refusal to purchase any of the <br />above described properties that were the subject to a bona fide offer to sell in the <br />following manner. <br />17.2 Owner shall notify Lessee in writing of an offer for sale of any of the above <br />described properties which Owner desires to accept, together with a copy of such offer to <br />sell, offer to purchase, or contract of purchase or document setting forth such offer. <br />4. <br />
