<br />The Lessee shall apply for, obtain and maintain in full force and effect any permits, <br />consents, or approvals as maybe required from the Colorado Division of Water Resources <br />and any other govermnental agency. <br />9. COMPLIANCE WITH LAW. The Lessee shall conduct its operations in <br />full compliance with all federal, state, and local laws, administrative orders, rules and <br />regulations. <br />]0. NON-LIABILITY OF OWNER. The Lessee covenants that the Owner <br />shall not be liable for any damage or injury to the Lessee's agents, employees, or business <br />invitees, or any personal property of any of them, and the Lessee agrees to indemnify and <br />save the Owner harmless from all claims of any nature whatsoever in any manner arising as <br />a result of lessee's operations upon the Leased Premises. <br />The Lessee shall maintain in full force and effect during the term of this Lease <br />public comprehensive general liability insurance written by an insurance company <br />authorized to transact business operations in the State of Colorado covering the Leased <br />Premises and the Lessee's business operations thereon with liability limits of <br />$ 1,000,000.00 per occurrence and $ 100,000.00 property damage. The policy or policies <br />of insurance shall name the Owner as additional insured, and shall be endorsed to provide <br />that no reduction in coverage, amendments in coverage, or cancellation of coverage shall <br />be effective unless the Owner has received not less than 10 days prior written notice <br />thereof. The Owner shall be provided copies of all insurance binders, policies, and <br />endorsements in force throughout the term of this Lease. ' <br />11. INSPECTION OF PREMISES. The Lessee shall allow the Owner or its <br />agents of representatives to enter the Leased Premises at any reasonable how during the <br />lease term to inspect the Leased Premises. <br />12. SURRENDER OF PREMISES. At the expiration of the term of this <br />Lease, the Lessee will surrender the Leased Premises and leave the same in the same state <br />and condition as when received, subject only to those alterations in the Leased Premises <br />brought about by the approved reclamation plan. The Lessee shalt, upon expiration of the <br />term of this Lease, be permitted to remove all personal property and equipment of any <br />nature from the Leased Premises, so long as there is no default by Lessee under the terms <br />hereof. <br />13. STOCKPILING. In the evem the Lessee stockpiles any sand, gravel, rock <br />or fill materials upon the Leased Premises, the same shall be removed by not later than the <br />end of the term hereof. In the event any such stockpiled materials aze not so removed, the <br />same shall be the property of Owner. <br />3. <br />
