Provisions outlined in Rule 3.1.9(3) of the Mineral Rules and <br />Regulations require topsoil stockpiles to be stored in places <br />and configurations which minimize erosion. Since the entire <br />site is within the 100 year floodplain of the South Platte <br />River, topsoil stockpiles will be subject to potential erosion <br />from flooding. To minimize the potential for erosion, the <br />operator will need to commit to forming elongate stockpiles <br />aligned with the river. The Division can accept the mining and <br />reclamation plans outlined in the application if the operator <br />commits to do so. <br />A flood plain development permit is not included on the list <br />of other permits in Exhibit M. Please outline any <br />requirements or permits for operating in the flood plain. <br />Describe any activities or floodplain erosion control <br />structures to be installed in accordance with the permit. <br />Berms, rip-rap, diversion ditches and other structures built <br />on the mine property need to be included on Map C-2, <br />described, and identified as permanent or temporary. For all <br />temporary structures, provide the construction dimensions and <br />materials in sufficient detail so that reclamation costs of <br />the structures can be calculated. <br />4. The mining and reclamation plans state that an average of 6 <br />inches of topsoil will be removed, stockpiled, and replaced <br />during reclamation. During our inspection of the site, <br />topsoil in excess of 15 inches was measured in the permit <br />area. Because the reclamation plan includes re-establishment <br />of pasture grasses for cattle and horses in Phases 2 and 3, <br />the applicant must state their commitment to stockpile and <br />replace a minimum 12 inches of topsoil. <br />5. The reclamation plan states that inert fill generated off the <br />permit will be imported for use as backfill. Please provide <br />the information required in Rule 3.1.5(9)(a)-(e). As a <br />reminder, Rule 1.1(20) states that concrete must be in a <br />hardened state for at least sixty days before being use as <br />fill. <br />6. Please address the concerns outlined in the letters from Bataa <br />Oil, Inc. and the Division of Water Resources, Office of the <br />
