The Division of Minerals and Geology <br />(Division) is required to make an approval or denial decision no <br />later than December 18, 1997, therefore, your response to the <br />following adequacy review concerns should be submitted to the <br />Division as soon as possible. If you feel more time is needed to <br />complete your reply, an extension to the decision date can be <br />granted by the Division. This will be done upon receipt of a <br />written waiver of your right to a decision by December 18, 1997 and <br />request for additional time. This must be received no later than <br />the deadline date. <br />1. As required by Rule 1.6.2(g), please provide proof of notices <br />to all owners of record of surface and mineral rights to the <br />affected land and all owners of record of surface lands, <br />including easement holders, that are within 200 feet of the <br />boundary of the affected land. A copy of the signed, <br />certified mail return receipt card is acceptable. <br />2. Please provide a copy of the Stormwater Management Plan or a <br />letter from the Colorado Department of Public Health and <br />Environment stating one is not required. If any storm water <br />control structures are required to be constructed at the mine- <br />site as a result of the storm water permitting process, the <br />operational and reclamation aspects of such structures must be <br />included in the Reclamation Permit. <br />
