The Division of Minerals and Geology (Division) is required to make an approval or denial decision no later than December 18, 1997, therefore, your response to the following adequacy review concerns should be submitted to the Division as soon as possible. If you feel more time is needed to complete your reply, an extension to the decision date can be granted by the Division. This will be done upon receipt of a written waiver of your right to a decision by December 18, 1997 and request for additional time. This must be received no later than the deadline date. 1. As required by Rule 1.6.2(g), please provide proof of notices to all owners of record of surface and mineral rights to the affected land and all owners of record of surface lands, including easement holders, that are within 200 feet of the boundary of the affected land. A copy of the signed, certified mail return receipt card is acceptable. 2. Please provide a copy of the Stormwater Management Plan or a letter from the Colorado Department of Public Health and Environment stating one is not required. If any storm water control structures are required to be constructed at the mine- site as a result of the storm water permitting process, the operational and reclamation aspects of such structures must be included in the Reclamation Permit.
