/ / <br />Mr. Joe Kurys • - 2 - • September 2, 1992 <br />Exhibit A <br />It is uncertain just what parts and ho•.+ much of Section 32, Township 39N, <br />Range 8E N.M.P.M. are to be included in the permit area and to comprise <br />affected area. Information on the first page of the application <br />indicates location of the permit area to be in the NE SW of Section 32. <br />That would appear to correspond to the 17 acre tract that adjoins the <br />Willow Crest Nursing Home site north Of East Drive: If, as the lease <br />indicates, 5.04 acres of this tract ar? not involved, then this leaves a <br />total of 11.96 acres in that area. In other portions of the permit <br />application, references are made to a ~ acre tract that appears to lie in <br />the NW SW NW of Section 32 and to anoLner 4 acre tract that lies in the <br />northern part of the SW NW Section 32, occupying the area immediately <br />north of Pond #l. While the legal description for the 6 acre tract in NW <br />SW NW Section 32 does appear to total 5 acres, measurements made of the <br />map representation provided of the 4 acre tract north of Pond 1 appears <br />to yield an area of more than 4 acres, i.e. approximately 6.5 acres. <br />Even under the most conservative interpretation, a total of nearly <br />22 acres seems to be involved (11.96 6 + 4) or as much as 24.5 acres <br />(11.96 + 6 + 6.5) in the proposed permit area. This does not agree with <br />the 17 acres stated to be in the permit area cn page 1 of the application. <br />The applicant will have to mere accurately specify and indicate cn <br />Exhibit E maps which tracts and which parts of which tracts are to make <br />up the permit area and provide accurate total acreage values. The <br />applicant will also have to specify and indicate on the Exhibit E maps <br />the areas of intended disturbance ~dhicn must total less than 10 acres in <br />e:<tent. <br />E±hibit A. (COnt'd) <br />The applicant indicates that, in C352 :f the 2 tracts totaling 10 to 12.` <br />acres in the SW NW Section 32, that the city is the surrounding sur'ac2 <br />landowner. It is nor clear to the Division, however, if the city owns <br />all the surf ac? adjacent to the 11.96 acre tract in the NE SW Section 32. <br />The applicant should review 'the proper-y ownership in the areas cf all <br />three tracts that may be included in the permit area and indicate if the <br />city owns all the surface adjacent to Lnes2 tracts. if not, these owners <br />should be indicated on the Exhibit E mass of the permit area and should <br />be notified of the permit application. <br />F<hihit R <br />Ther? is no description cf the soli C~aracteristics in the areas of the <br />proposed operation. <br />The adplicant should contact the 1oca~ cfflce of the Soil Conservation <br />Service and s?cure a description of the soils in the pr:;oosed permit ar?a <br />in order to satisfy this requir?men t. <br />
