Impact on Quality of Life: Existing land use patterns in tl,e <br />Animas Valley from Durango nort'1~ to Hermosa contain a mixture of single <br />family residential, mobile Home parks, commercial, well as extractive <br />and related industrial activities. In the immedi to vicinity of the <br />proposed sandpit is t}re United Construction wetlands extraction and fill <br />operation, as well as the Val-Air Gliderport, in add'tion to residential <br />properties. Given the character of tl~e existing and use patterns in <br />ttie immediate vicinity and the natrire of the pro osed operation, it <br />would appear that t}ie land use impacts associated wi h tl~e operation can <br />be substantially mitigated provided t}iat it is con ucted in the manner <br />set forth in L-l~e application in accordance wit}, th se terms and condi- <br />tions designed to mitigate such impacts. <br />6. State Agency Approval: Given t}ie extra tive nature of tl~e <br />proposed land use, any County approval should be a pressly conditional <br />upon the Applicant receiving and maintaining, at 'll times, Colorado <br />Mined Land Reclamation Board approval, as well s all approvals or <br />permits from relevant state agencies. Should such pprovals or permits <br />be suspended or revoked, such action should be srfficient cause for <br />revocation or suspension of local land use approval. <br />7. Enforcement: Since any approval of t2~e proposed sandpit <br />operation must be conditional upon the operator's compliance with any <br />terms and conditions which this Board attac}ies t suc}, approval, in <br />order for t}~e operation to be compatible with th surrounding area, <br />provision should be made for tl~e enforcement f those terms and <br />conditions, including t}re revocation or suspensi of such approval <br />should it be establis}aed to tl.e Board's satisfactio that the operation <br />is not in compliance wit} any terms and conditions }rich the County may <br />attac}, to such approval. <br />NOW, THEREFORE, AE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF <br />LA PLATA COUNTY, COLORADO AS FOLLOWS: II <br />1. Tl~e application of John Dillon, dba Sandco of Dlrrango, for a change <br />in Iand use to allow a mineral extraction operation for emoval of sand from <br />a sand bar located on the west bank of tt~e Animas River is kiereby approved, <br />sucl; approval being expressly subject to and conditioned upon the operator's <br />compliance with tl~e following terms and conditions. <br />
