<br />3. T},e operations of t},e Willow Bend Sandpit sl,al be, at all times,
<br />in compliance with tl,e findings of t},is Board as stated },e ein above. Speci-
<br />fically, at. no time s},all t},e extractive operations go bey nd tl,e actual sand
<br />bar area located within t},e boundaries of the affected mi ing area as stated
<br />on tl,e land use application, consisting of about 1.0 0 1.5 acres. The
<br />operations shall consist of only one medium-sized front- nd loader and, at
<br />any given time, only one medium-sized dump tnick, of ten to twelve yards of
<br />hauling capacity, shall be loaded on tl.e site. There i to be no stock-
<br />piling, cn,s},ing, or processing of any materials at tk~e s to nor any storage
<br />of equipment, machinery, or vehicles, except for tl,e fron -end loader during
<br />actual mining operations, at t},e site. All equipment a vehicles located
<br />and operated on t}~e site s}.all },ave fully operation 1 muffler devices
<br />attached at all times during operation. T}~e hours of peration s},all be
<br />confined to daylight, and in no case earlier t}ian 7:30 a m. nor later than
<br />6:30 p.m., Monday tl,roug}, Saturday. T},ere is to be no c shing or material
<br />processing operations conducted on the site at any time All hauling and
<br />equipment movement is to be confined to t},e mine area and he haul road to
<br />U. S. Hwy. 550. The haul road to U. S. Hwy. 550 s},all be raveled and dust-
<br />retardant applied, as necessary, to control fugitive dust. Tl~e operator is
<br />to use appropriate techniques and materials to control any fugitive dust
<br />w},icl, may be generated by the operation so as to prey nt any detectable
<br />levels of particulates from leaving the site. There are o be no operations
<br />on ti,e site during periods of high water or during perio s when t),e Animas
<br />River is at flood stage. Any equipment or machinery p esent on t},e site
<br />shall be promptly removed during periods of hig}i water o when flood danger
<br />is present. There shall not be any encroact,ments, fil s, stn~ctures, or
<br />substantial improvements located wit},in the floodway of tl, Animas River.
<br />• 4. Periodic Review and Enforcement.: T},is land use approval is
<br />expressly contingent upon and subject to the operators receipt of a,id
<br />compliance with all required state permits or approvals, 'ncluding, but not
<br />limited to, the permit for tf,e proposed operation require from the Colorado
<br />Mined Land Reclamation Board. S},ould t},e Colorado Mine Land Reclamation
<br />Board or any ot},er state agency, whose permit or approval s required for t},e
<br />Sandpit operation, suspend or revoke suc}, permit or appro al for the opera-
<br />tion, tl,e County's land use approval shall be deemed suspe ded or revoked, as
<br />appropriate. T},e operation of the Sandpit s1,a11 be review d by t},is Hoard on
<br />a biannual basis to determine if tl:e operation is in c mpliance with tl,e
<br />terms and conditions of County land use approval set for h in this Resolu-
<br />tion. Sucl, biannual review shall be }field wit},in the nine y (90) day period
<br />preceding such anniversary date. Any written allegations l,at t},e Sandpit is
<br />operating in violation of the terms and conditions of approval s},all be
<br />referred to t},e County planning staff for investigation. Tl,e County staff
<br />s},all promptly investigate any such written allegations co cerning violations
<br />and report t},eir findings to t},is Board.
