C of the permit. <br />This will eliminate the needjoreoverage under more than onepermitfor mostsuch facilities. However, as discussed in Section V.A.2. <br />ojthe Rationale, some facilities may wish to apply for an individua(permi[ instead, in order to take advantage ojsomejederal effluer. <br />guidelines not included here. Additionally, as discussed in Section IILB ojrhe Rationale, the Water Quality Control Division ojth <br />Colorado Department ojPublic Health and Environment (the "Division') retains the authority to require anyfacility to be covered unde <br />an individual permit. <br />III. COVERAGE UNDER THlS PERMIT <br />A. Industrial Categories <br />The types ofjacilities covered by this permit include al! mining and quarrying ofnonmetallic minerals, except farels. This !s th <br />description ofStandard Industrial Classification (SIC) Code 14. Also, stormwaterfrom asphaltand concrete batch p/ants locate <br />at sand and gravef operations is included here, due to their sunilarfry to the covered mines in pollution potential, and thei <br />function as an adjunct to the mine operations. (The definition ojasphalt and concrete batch plane can include the use c <br />recycled asphalt or concrete.) F.xem~hbns~rSmallMunici alitie <br />The Intermodal Surface Transportation Efficiency Actoj1991 Section l068(c) added an exemption to the stotmwatertzgulation <br />formunicipalities with less than IOO,000population. Tke term "municipality"includes cities, towns, counties, special districts o <br />any entity created by or pursuant to State law. <br />Stormwater discharges associated with industrial activity (except for airports, steam electric power plants, or uncontrolle, <br />sanitary landfills), thatare owned or operated by a small municipality are notrequired to applyfor orobtain astormwaterperm+ <br />until March /0, 2003. This exemption is onlyjor discharges ojstormwater. (Note: This exemption does not apply to other <br />privately owned industries within the same small municipality) <br />IV, CERTIFlCATlON <br />A. Permit Certi~eaHons <br />This permit is made up ojseveral parts, some of which do not apply to all permiaees (i.e., while most facilities will regain <br />coverage under the stormwatersection /.C, many will not require coverage under the process water section /.B). Therefore, [h <br />individual certification prepared for each applicant will indicate whether that applicant must follow Part I.B ofthe permit. In a~ <br />cases (except as noted in Section III.C, above), Part I.C must befollowed. (In the absence ofsuch indication from the Division <br />the permiuee will be responsible for determining and then romplying with the applicable sections in Part L) In addition, ai <br />nermtaees will be required to comply with Part !, subparts A, D, E and F, and al! ofPart !I ojthe permit. <br />
