The General Permit system jar regulating sand and gravel production operations has worked well jo. <br />the State ojColorado. <br />The following minor changes have been made to the permit and Rationale during renewal: <br />A. SrnallMuntctpalitvF.xemotion: The RationalediscussionontkestormwaterpermittingExemptionsforSmallMunicipalitie <br />(Section lILB) has been changed to include the March /0, 1003 deadline for permit coverage for municipally owner <br />industries. This did not involve any changes to the permit. <br />B. Reanolication: Authorization to drschatge under thisgeneral permit will espire on September 30, 2007. Forcertification: <br />covering stormwater discharges only ~.e., the permittee's individual certification does not indicate that Part I.B of thr <br />permit must be followedJ, the deadline for reapplication for continued coverage under the general permit has been changer <br />to ninety-days prior to permit expiration, or June 30,1007. The due date for permittees certified to discharge storrnwate: <br />a~ process water will remain as 180 days before permit expiration, or March 31, 2007. <br />C. A paragraph was included in the introducmry page explaining the right ofanyparry to an adjudicatory hearing contesting <br />the renewal of this general permit, as per the Colorado Discharge Permit Svstem Regulations. Regulation No. 61, (S CCI <br />1002-till. Note that thrs does not provide for an adjudicatory hearing for a certifrcation issued under this general permit <br />D. Impacted Stream Seements: For this general permit, any existing or new operation that discharges to a segment that is lister <br />on the Division's 303(dJ list ojimpacted stream segments may require an individual permit The 3030 segments art <br />segments in whick water quality standards for one or more pollutants are exceeded. <br />For most, ifnot all, of the operations that discharge under this permit, there are no monitoring data to verify the expectatior <br />that these discharges will not impact a lrsted segment. Therefore, far those facilities that discharge process water tt <br />segments on the 303(d) list, the permittees will be required to perform a one-time analysts upon commencement ojdischarg~ <br />for the !sited parameters ofconcern to confirm that stream standards for these parameters are not exceeded in the discharge <br />concenhations. <br />Where the receiving water u included an the state's 303(d) list, total maximum daily loads (TMDLs) are being developed it <br />accordance with the Division's schedulejor TMDL completion. Once a TMDL has been established, ijit it necessary n <br />incorporate limitations for afacility certified under this general permil which are based upon the outcomes ofthe TMDL o <br />the results ojthe one-time analysis. an individual permit may be written to regulate drschargesfrom thisjaciliry. Thejacilir <br />would continue to be covered under this general permit cernfication until the individual permit is issued. <br />Il. STORMWATER PROGRAM <br />As required under the Clean Waterrdct amendments of1987, the Environmental Protection,4gency (EPAJ has established aframewon <br />jorregulatingmunicipalandindustrialstormwaterducharges. TkisframeworkisundertheNationalPollutanrDischargeEJiminatim <br />System (NPDES) program. The regulations (40 CFR 112.26) require specific types of industria[jacilities which discharge stormwate <br />associated witk industrial activity (industrial srormwater), to obtain coverage for this discharge under an NPDES permit. Facilitie <br />which discharge industrial stormwater either directly to rut face waters or indirectly, through municipal separate storm sewers, must b <br />covered by a permit. <br />
