Preliminary Toxicity Investigation (Continued) <br />If toxicity dyTrrra--e durirg the preliminary toxicity investigation, <br />the permittee shall submit written notification to that effect to the <br />Division. Phase I THE <br />The Phase I THE performed by the permittee shall be in general <br />accordance with Methods for Aquatic Toxicity Identification <br />1988) published by EPA, or in accordance with procedures approved by <br />the Division. If only one species demonstrated toxicity duri~ <br />accelerated testing, then that species alone may be us~l in the Phase <br />I TRE. The permittee has 45 days fr'® the ~+~~++~~~ion of the final <br />report on the preliminary toxicity investigation to complete the Phase <br />I ZRE and sutanit a report to the Division on the results of the study. <br />If the Fhase I THE identifies a probable toxicant and/or a probable <br />source of toxicity, the permittee shall submit written notification to <br />that effect to the Division as part of the report. Within 30 days of <br />completing the Phase I TSB, the permittee shall submit for the <br />Division's approval a control program to control WET, and shall <br />prxeed to implement suds plan within 7 days following approval by the <br />Division. <br />If the Phase I THE Pails to identify a probable toxicant and/or a <br />probable source of toxicity, the permittee shall notify the Division <br />of its findings. the Division will dPterm;*~ whether a Phase II THE <br />is applicable. <br />If toxicity d~ z~*~ durirx3 the Phase I T1~, the permittee shall <br />submit written notification to that effect to the Division.
