Section 816.150 (a) Continued <br />816.76 on the grounds that Kerr Coal will thereby insure compliance <br />with the applicable environmental protection performance standards <br />under SMCRA. <br />It should be noted that applicable performance standards for road <br />design, construction, maintenance, and removal under the original <br />SMCRA provisions (1979) generally parallel current OSMRE and CDMG <br />regulatory requirements. Designations for Class I, Class II, and <br />Class III roads in the following discussions are analogous to the <br />current regulatory classifications of Haul, Access, and Light-Use <br />roads, respectively. <br />The remaining road within the Kerr Tipple Area has been constructed, <br />reconstructed and maintained to meet applicable regulatory <br />requirements and to control or minimize erosion, siltation, air and <br />water pollution, and damage to public or private property. Only one <br />"Haul Road^ remains and is shown on Map 29, Kerr Tipple Area <br />• Existing Structures. This road is on property owned or controlled <br />i by Kerr Coal. <br />Approximately two miles of Haul Road that previously existed within <br />the Kerr Mine Area has been narrowed in conjunction with site <br />Teclamation via Minor Revision 25 (MR-25) and its designation <br />changed to a Permanent Light-Use Road. Proposed Haul Road B has <br />been redesignated as a Temporary Light-Use Road for monitoring and <br />maintenance of Pond "G". When/if Pond "G" is removed at some time <br />in the Future, Haul Road B will likewise be removed and reclaimed <br />at that time. Light-Use Roads in the Kerr Mine Area are shown on <br />Map 28a, Kerr Mine Area Existing Structures. <br />The existing Tipple Road is a paved road with an existing drainage <br />ditch on the north side of the road.
