Since lands will be restored to their historic and same <br />useage as surrounding undisturbed laude, approval of local, state <br />and federal agencies for the postmining land use plan is unneces- <br />sary. Written comments have been received from existing land <br />owners and their feelings about proposed postmining land uses are <br />set forth in Exhibits 54, Comments of Surface Owners. <br />The proposed rangeland use as described in Sections 779.22 and <br />780.23 will be restored by implementation of the reclamation pro- <br />cedures and according to the reclamation timetable presented in <br />Section 780.18. Implementation of this timetable will assure that <br /> <br />a contemporaneous reclamation program will be conducted to imple- <br />ment the proposed rangeland land use. <br />S(~ Section 816.150 Roads: Class I: General. <br />(a) Each person who conducts surface mining activities shall design, <br />construct or reconstruct, utilize and maintain Class I Roads and restore <br />the area to meet the requirements of 30 CFR 816.151-816.156 and to <br />control or minimize erosion and ailtatlon, air and water pollution, and <br />damage to public or private property. <br />On May 16, 1980 the District Court for the District of Columbia <br />remanded the performance standard regulations at 30 CFR 816.150- <br />816.176, See, Ici'Re"S6tface'Mining'Litigatidit, " '" F.
