~~ <br />L <br />Section 816.133 (a) Continued. <br />existed in the area prior to mining or construction of the tipple. <br />The previous experience of Kerr Coal indicates that on the average, <br />total plant cover and plant production on reclaimed lands, both on <br />the Marr Mine and on adjacent drill pads seeded to BLM specifi- <br />cation indicates that premining plant cover and production can be <br />achieved on reclaimed sites in approximately 4 to 5 years. The <br />data contained in Section 779.19 should be consulted to determine <br />the rate of vegetative recovery on disturbed sites. <br /> <br />(b) Determining premining use of land. The premining use of land to <br />which the postmining land use is compared shall be those uses which the <br />land previously supported, if the land has not been previously mined and <br />had been properly managed. <br />(1) The postmining land use for land that has been previously mined and <br />not reclaimed shall be judged on the basis of the highest and best use <br />that can be achieved and is compatible with surrounding areas. <br />(2) The postmining land use for land that has received improper manage <br />went shall be judged on the basis of the premining use of surrounding <br />lands that have received proper management. <br />(3) If the premining use of the land was changed within 5 years of the <br />beginning of mining, the comparison of postmining use to premining use <br />shall include a comparison with the historic use of the land as well as <br />its vas immediately preceeding mining. <br />The premining land uses are shown in Map 27, North Park Land Use; <br />the narrative describing changes in land use are presented under <br />Section 779.22. The proposed postmining land use will involve <br />restoration of all land to its premining land use of rangeland. At <br />816-170 <br />
