r~ <br />Section 816.133 (b) Continued. <br />the Kerr Mine Area, many acres were mined prior to the opening of <br />the Marr Mine in 1974. These lands were all historically used as <br />rangelands and have been and are in the current process of being <br />reclaimed to their historic and most productive use. Highest and <br />moat productive uses for lands at both the Kerr Mine Area and the <br />Kerr Tipple Area will be to restore them to conditions capable of <br />supporting the livestock grazing uses which were found on both <br />sites prior to disturbance. <br />A detailed historical land use presentation and discussion of al- <br />ternative land uses is found in Section 779.22. Examination of <br />those Sections indicates that the proposed restoration of the lands <br />as rangelands will result in these lands being restored to their <br />highest potential use. <br />l J <br />(c) Prior to the release of lands from the permit area in accordance <br />with 807.12 (c) the permit area shall be restored, in a timely manner, <br />either to conditions capable of supporting the uses they were capable of <br />supporting before any mining or to conditions capable of supporting <br />approved alternative land uses. Alternative land uses may be approved <br />by the regulatory authority after consultation with the landowner ar the <br />land-management agency having jurisdiction over the lands, if the fol- <br />lowing criteria are met: <br />(1) The proposed postmining land use is compatible with adjacent land <br />use and, where applicable, with existing local, State or Federal land <br />use policies and plans: A written statement of the views of the au- <br />thorities with statutory responsibilities for land use policies and <br />plans is submitted tot he regulatory authority within 60 days of notice <br />by the regulatory authority and before surface mining activities begin. <br />Any required approval, including any necessary zoning or other changes <br />required for land use by local, State, or Federal land management agen- <br />816-171 <br />
