Doc Date:12/11/2001 <br />Section 816.117 (c) Continued. <br />II I' II' II I II ~'II'I~ <br />(3) Upon expiration of the 5 or 10 year responsibility period and at <br />the time of request for bond release, each permittee shall provide <br />documentation showing that: <br />(i) the woody plants established on the revegetated site are equal to <br />or greater than 90 percent of the stocking of live woody plants of the <br />same life form of the approved reference areas with 80 percent statis- <br />tical confidence, and <br />(ii) the groundcover on the revegetated area satisfies Section 816.11fi <br />(b)(3)(iv). Species diversity, seasonal variety and regenerative capa- <br />city of the vegetation of the revegetated area shall be evaluated on the <br />basis of the results which could reasonably be expected using the reve- <br />getation methods described in the mining and reclamation plan. <br />• Premining land use did not include any forestry lands (Section <br />779.22). Postmining land use (Section 816.133) is designated as <br />an nd that term is defined in 30 CFE 701.5 and -the desig- <br />nate postminin use is identical to the premining use within the <br />propo permit area. The reforestation requirements contained in <br />this Section do not apply to this application. <br />(~F Section 816.131 Cessation of operations: Temporary. <br />J (a) Each person who conducts surface mining activities shall effec- <br />tively secure surface facilities in areas in which there are no current <br />operations, but in which operations are to be resumed under an approved <br />permit. Temporary abandonment shall not relieve a person of their <br />obligation to comply with any provisions of the approved permit. <br />816-165 <br />
