<br />Doc Date:12/ 021/ 01 <br />Section 816.101(b) Continued. <br />III'III II~ III <br />Revised 04/20/90 <br />Upon completion of mining and reclamation for the existing <br />operations, and if future development and use are determined <br />infeasible, all facilities at the Kerr Tipple Area will be removed <br />and the area will be graded to the approximate original contour using <br />dozers and motorgraders as shown on Map 36, Kerr Tipple Area <br />Postmining Topography. A precise description of the grading plan in <br />the context of the Kerr Tipple Area reclamation plan is discussed in <br />780.18. <br />Backfilled material will not adversely affect the ground water as <br />demonstrated by the discussion and testing results for spoil material <br />set forth under Sections 779.14 and 780.21 (c). The postmining use, <br />which will be rangeland, will be promoted by an undulating surface <br />which will minimize erosion and maximize water retention, yet <br />minimize the possibility of sliding. No cut and fill terraces will <br />be incorporated in the backfill and grading. <br />SI~~ Section 816.102 Backfilling and grading: General grading <br />requirements. <br />(a) The final graded slopes shall not exceed in grade either the <br />approximate premining slopes, or any lesser slopes approved by the <br />regulatory authority based on consideration of soil, climate, or other <br />characteristics of the surrounding area. Postmining final graded slopes <br />need not be uniform but shall approximate the general nature of the <br />premining topography. The requirements of this Section may be modified <br />by the <br />816-131 aaa <br />
