Section 816.102(a) Continued. <br />regulatory authority where the surface mining activities are reaffecting <br />previously mined lands that have not been restored to the standards of <br />this Part and sufficient spoil is not available to otherwise comply with <br />this Section. The person who conducts surface mining activities shall, at <br />a minimum-- <br />(1) Retain all overburden and spoil on the solid portion of existing or <br />new benches; and <br />(2) Backfill and grade to the most moderate slope possible, to eliminate <br />the highwall which does not exceed either the angle of repose or such <br />lesser slope as is necessary to achieve a minimum static safety factor of <br />1.3. In all cases the highwall shall be eliminated. <br /> Where applicable, Kerr Coal will retain all overburden and spoil on <br />• the solid portion of existing or new benches. As shown on Map 36, <br /> Kerr Mine Area Postmining topography, the final graded slopes may <br /> exceed approximate original premining slope grades. However, <br /> postmining slopes have been designed at a maximum slope of 3.OH:1.OV <br /> to insure maintenance of the required factor of safety. <br /> In the final pits, highwalls will be eliminated by backfilling in <br /> order to achieve the approximate original contour (see Sections <br /> 780.18 and 816.101 as well as Map 33, Kerr Mine Area Overburden <br /> Replacement and Grading.) The final graded slopes will not be <br /> uniform but will undulate to minimize erosion and maximize water <br /> retention for vegetation growth.
