.t <br />Revised 04/20/90 <br />Section 816.101(a) Continued. <br />coal removal, but because of the nature of the mining plan as <br />described in Section 780.11 and 780.18, the approximate original <br />contour cannot be achieved until approximately three years after the <br />coal has been removed. For these reasons, as more fully discussed <br />under Section 816.100, Kerr Coal requests an exemption from the 180 <br />day backfilling requirements to allow for backfilling and grading <br />according to the previously described mining and reclamation plan. <br />(b) Method for backfilling and grading. <br />(1) Except as specifically exempted in this Subchapter, all disturbed <br />areas shall be returned to their approximate original contour. All spoil <br />shall be transported, backfilled, compacted (where advisable to insure <br />• stability or to prevent leaching) and graded to eliminate all highwalls, <br />spoil piles, and depressions. <br />(2) Backfilled material shall be placed to minimize adverse effects on <br />ground water, minimize off-site effects, and to support the approved <br />postmining land use. <br />(3) The postmining graded slopes need not be of uniform slope. <br />(4) Cut and fill terraces may be used only in those situations expressly <br />identified in Section 816.102. <br />Kerr Coal will utilize available production and stockpiled overburden <br />to backfill and reclaim existing pit disturbance areas. Utilizing <br />available backfill volumes Kerr Coal has designed the postmining <br />configuration to eliminate all highwalls and depressions, provide <br />effective drainage, insure slope stability, and blend with <br />surrounding terrain. A precise description of the backfilling and <br />grading in the context of the overall reclamation plan for the permit <br />area is set forth in the discussion under Section 780.18. <br />816-130 <br />
