Special Use Permit #98-2~ <br />Tallier Gravel Pit <br />Page 2 <br /> <br />11. No mining shall occur within 50 feet of the drainage, and all stream and wetlands crossings shall have a <br />404 permit in place as well as a county water body setback permit. <br />12. This permit is contingent upon permits being obtained for air and water emissions, reclamation, and other <br />appropriate permits from all involved agencies. <br />13. All haul roads and disturbed sites shall be watered and chemically stabilized to minimize dust. Watering <br />operations shall be increased immediately in response to periods of high wind. <br />14. The. pernittee shall provide evidence of liability insurance, in the amount of no less than $600,000 per <br />occurrence with either unlimited aggregate or a policy endorsement requiring notice to Routt County of all <br />claims made. Routt County shall be named as an additional insured on the policy. <br />15. The permittee shall apply for and receive a Mined Land Reclamation Board permit and post a <br />reclamation bond with the MLRB prior to commencing any operations. The permittee shall be <br />responsible for reclamation as set forth by the Colorado Division of Minerals and Geology gravel mining <br />guidelines. All buffer zones required by the Div. Of Minerals and Geology permit shall be included as a <br />part of this permit, if they are more stringent than those set forth herein. <br />16. The Special Use Permit is contingent upon the petitioner complying with the applicable requirements of <br />Regulation III.D of the Colorado Air Quality Control Commission, as a minimum standard, with the <br />following stipulations: <br />A. The operation shall establish a state approved fugitive dust control plan for the sand and gravel <br />operation. Periodic inspections by the state and county could then be used to determine <br />compliance with the plan. <br />B. The dust control plan shall be formulated by the petitioner in cooperation with the planning staff, <br />then forwarded to the Colorado Air Quality Control Division for final approval, and is subject to <br />control and administration by Routt County, i.e., Planning Department staff and/or Department of <br />Environmental Health. <br />C. The dust control plan can be amended by Planning Commission and the Board of County <br />Commissioners if found'to be necessary. <br />D. The dust control plan shall address site specific issues of concern, such as the topsoil stockpiles <br />and wind breaking. The slope of the stockpiles shall be contoured to a slope conducive to <br />vegetative cover. Windbreaking shall occur as necessary by placement of gravel stockpiles er <br />other material in a manner so as to prevent blowing of material from such piles. This condition <br />will apply to stockpiles and any berms which may be developed. <br />17. All applicable standards set forth by the Colorado Department of Health and the Routt County <br />Department of Environmental Health shall be complied with. The operation shall comply with all Federal, <br />State and local laws. <br />18. Fuel, flammable materials, or hazardous materials shall be kept in a safe area as approved by the Chief <br />Building Inspector and Department of Environmental Health. <br />19. The pertnittee shall notify the Planning Department staff of the date of commencement of operation to <br />ensure that the conditions of this approval which must be met prior to commencement of activity on the <br />site have been complied with. <br /> <br />
