Comply with all applicable conditions of Section 8.3.1 (under General Requirements checklist), and <br />Section 8.3.1.3 (Sand and Gravel requirements). <br />2. The special use permit is limited to uses and facilities presented in the original project plan. Any <br />additional uses or facilities must be applied for in a new or amended application. <br />3. Any complaints or concerns which may arise from this operation may be cause for review of the Special <br />Use Permit, at any time, and amendment or addition of conditions, or revocation of the permit if <br />necessary. <br />4. The operator shall prevent the spread of weeds to surrounding lands, and comply with the Undesirable <br />Plant Management Act, adopted in 1990. <br />5. The permittee shall be responsible for any court and attorney fees if Routt County deems it necessary to <br />enforce any of the conditions of the Special Use Permit and is successful in such court action. <br />6. No junk, trash, or inoperative vehicles shall be stored or allowed to remain on the property <br />7. The Special Use Permit is valid for ten years for Phases 1 & 2, provided it is acted upon within one year <br />of approval. <br />8. The operation will be reviewed after the first year of operation and thereafter every two years by Planning <br />Staff to ensure compliance with permit conditions, with recommendations to Planning Commission as <br />appropriate. <br />9. A maximum of 6 acres shall be mined at a time. Reclamation including grading, topsoiling to a minimum <br />of 12' in depth, and seeding shall occur concurrently with mineral extraction in each area. The most <br />visible portion of Phase I- shall be mined and reclaimed first, to minimize visibility impacts to the <br />neighbors. <br />S? <br />10.
