Inc. (hereinafter referred to <br />as Moon Lake), and <br />Whereas, said gravel pit operation being located in the S1/2 <br />NW1/4 NW1/4 and the N1/2 SW1/4 NW1/4 of Sec. 10, T1N, R102W, 6th <br />PM in Rio Blanco County Colorado and, <br />Whereas, said gravel pit operations involve men and <br />equipment around and under the conductors and near four poles of <br />the power line, <br />Now therefore, Moon Lake and County agree that this activity <br />and use may occur within the right-of-way of the power line only <br />in compliance with the following stipulations: <br />1) A fifty (50) foot buffer of undisturbed earth on tt~e <br />north, east, and west sides shall be maintained around each pole <br />o£ the power line. Beyond this undisturbed earth, excavation <br />taking place shall maintain a slope not steeper than 3:1 <br />(Run:Rise) being measured from the edge of the buffer zone to the <br />bottom of the gravel pit. <br />2) If the slopes around the buffer zone shall begin to <br />degrade any time after they are initially established, they shall <br />be restored to a maximum slope of 3:1 by Rio Blanco County within <br />sixty (60) calendar days. Degrade shall mean to blow away, wash <br />away, or increase in slope greater than 3:1 for any reason. <br />3) To assure that an inaccessible island is not created <br />around a pole and to assure future access to each pole, no <br />excavation shall occur on the south side of the poles to a width <br />of fifty feet on either side of the pole and extending to the <br />south beyond the gravel pit area. <br />4) There shall be no parking of vehicles or overnight <br />placement or storage of equipment under the power line or in tY:e <br />right-of-way. <br />5) There shall be no burning with open flame near the power <br />line. <br />19VUIY LHl~G LLGVIRIU <br />1 <br />
