Vol. 5, pages 1292-1296.3 <br />From November 10, 1988, the date Battle Mountain was notified <br />that its application was complete, until the first public hearing, <br />an "adequacy" review was undertaken by the MLRD pursuant to Rule <br />1.5.5(1). During the adequacy review the MLRB received comments <br />from CES and the concerns expressed therein were addressed by the <br />MLRB and Battle Mountain. Vol. 1, pages 30-53, 800. <br />As a result of the adequacy review, a letter was presented by <br />the MLRD to Battle Mountain identifying issues whit:h required <br />further technical clarification. Vol. 4, pages 8:w7-844. A <br />detailed response to the MLRD's adequacy letter was submitted by <br />Battle Mountain on February 15, 1989. Vol. 5, pages 916-953. The <br />MLRD made additional supplemental requests for information during <br />the permitting process to which Battle Mountain submitted <br />additional information. At a <br />January 25, 1989 Board meeting, the Board granted C]ES' request <br />pursuant to $34-32-114 C.R.S. for a public hearing on Battle <br />Mountain's permit application. The Board determined that a public <br />hearing would be held in Alamosa on February 23, 1989.
