the hearing was served upon all interested persons by the MLRB on <br />February 14, 1989. <br />At the February 23, 1989 hearing in Alamosa, the MLRB received <br />the testimony of Steve Renner, MLRD, regarding project design, and <br />project measures to minimize impacts to the hydroloogic balance <br />including water quality and quantity issues. Vol. 2, pages 159- <br />211. The MLRB received testimony from CES members regarding water <br />quality issues. Vol. 2, pages 251-323. It also received public <br />comment in support of the project. Vol. 2, pages 325-339. Battle <br />Mountain agreed to defer its response to allow additional time for <br />public comment. <br />On March 9, 1989 notice was sent to all interested parties <br />that the hearing would be continued in Denver on March 22, 1989. ~ <br />At this hearing the MLRB received further testimony from Steve <br />Renner, MLRD, regarding project design including the proposed <br />construction of a slurry wall as necessary to minimize potential <br />project related depletions to the Rito Seco, a creek near the mine <br />site. Vol. 3, pages 460-461. The MLRB received testimony of <br />Battle Mountain experts regarding project design and reclamation, <br />impact of the operation on the hydrologic balance, measures <br />utilized to minimize disturbance to the hydrologi~.c balance, <br />including impacts to surface and ground water quality and quantity, <br />project water needs, project water sources and efforts and <br />commitments to obtain proper project water rights.
