• ~ Page 2
protection under the Endangered Species Act (Act), it is within the spirit of
the Act to consider project impacts to potentially sensitive candidate
species. Additionally, we wish to make you aware of the presence of Federal
candidates should any be proposed or listed prior to the time that all Federal
actions related to the project are completed.
FEDERAL CANDIDATE SPECIES
Northern goshawk
Roundtail chub
Colorado Rvr cutthroat trout
Lomatium concinnum
Penstemon mensarum
Penstemon retrorsus
Accipiter gentilis
Gila robusta
Oncorhynchus clarki pleuriticus
Colorado desert-parsley
Grand Mesa Penstemon
Adobe beardtongue
In addition to the candidate species listed above, several candidate species
of bats could also inhabit the area. The property should be surveyed for
caves, abandoned mines, or other bat roosting habitats which might be
disturbed by exploratory drilling or mining. The three candidate plant
species listed above have been located in the North Fork valley downstream of
the project property.
Be advised that the Fish and Wildlife Service can enter into formal section 7
consultation only with another Federal agency or its designee. Thus, this is
not to be considered an "official species list" but rather informal
consultation. Informal consultation includes all contacts, discussions,
correspondence, etc. between the Federal agency or its designated nonfederal
representative, and the Service, that take place prior to the initiation of
any necessary formal consultation. If requested, we will submit an official
list to the lead Federal agency. That agency would be required under section
7 (a) (2) of the Act to initiate formal consultation if it determines that its
action may affect any listed species or its critical habitat. Although
applicants may fill the role of nonfederal representatives, the ultimate
responsibility for compliance with section 7 remains with the Federal agency.
If the Service can be of further assistance, please contact Martin Miller at
the letterhead address or (910) 243-2778.
Sincerely,
I•
eith L.
