NO IMPACT SUBDIVISIONS <br />.; <br />The Board of County Commissioners may modify the submittal requirements <br />for major and minor subdivisions when the division of land is for the purpose of <br />dividing improved lots or parcels as defined in this policy. <br />A. Definffions <br />No Impact. For purposes of this policy no impact shall mean a division of land <br />in which all the lots (existing and new) have already been developed with <br />habitable residences, functional business structuresor uses, or agricultural <br />parcels that will remain exclusively_agriculture. <br />Continuously Inhabited or Occupied. For purposes of this, Interim Policy <br />continuous inhabitation or occupation shall mean the dwelling unit or <br />business has been used for dwelling or business purposes without an <br />interruption. A vacancy of less than 90 days shall not be considered an <br />interruption unless there is more than one such vacancy in a calendar year. <br />The Board may make an exception in the cases of seasonal businesses. <br />B. Eligibility Criteria <br />To qualify for a No Impact Subdivision the proposed land division must meet <br />the following criteria: <br />1. The land division must meet the definition of No Impact. <br />2. The existing residences or business must have been in place and <br />continuously inhabited or occupied for ten years. <br />3. Prior to the signing of the Final Plat, the developed lots must have separate, <br />approved domestic water and sanitary sewer systems, and electrical lines or <br />meters. All lots must have an approved access to a public road. <br />C. Procedure <br />The procedure for No Impact Subdivisions shall be as specified for a Major or Minor <br />Subdivision in the Delta County Subdivision Regulations except as modified by this <br />Policy, as follows. <br />
