.. . <br />restriction reading substantially as shown below shall be placed on the <br />conveyance and recorded by the staff, concurrently with the final plat. <br />The deed restriction can be removed or amended by the Board, based <br />on change of circumsfances which effher make~the original restrictions <br />unfair or unlawful or results in an individual or family hardship, such as <br />financial, death, disability or divorce. <br />The deed restriction shall read as follows: <br />' In accordance with Delta County Regulations, this property may not be <br />conveyed to other than a family member, as defined by said <br />regulations, for a period of seven years from the date hereof, without <br />- approval of the Delta County Board of County Corimissioners. Such <br />approval would normally be limffed to hardship' situations.' <br />4. The exemption shall conform to all the requirements of the Delta <br />County Subdivision and Minor Subdivision Regulations and administrative <br />rules except as modified by this policy. <br />C. Procedure. <br />1. The procedure for Family Split subdivisions shall be as specified for a <br />Major or Minor Subdivision in Delta County, including notification of <br />adjacent properly owners, except as modified by this Policy. <br />2.7he fees for processing and open space fees shall be as specified for a <br />Major or Minor Subdivision. In addition to the regular fees, a special <br />Accelerated Processing Fee, not to exceed S250.00, may be required. <br />The staff will make a recommendation concerning the imposition of the <br />Accelerated Processing Fee when the BOCC reviews the sketch plan. <br />3. Upon determination that an application for a Family Split is complete, <br />the application shall be accepted and scheduled for a regular or <br />special meeting of the Planning Commission. Such Planning Commission <br />meeting shall be within 60 days of the date the application is accepted. <br />The staff may recommend that the subdivision be considered on a <br />Consent Agenda. <br />4. If the Family Split is approved by the Board of County Commissioners any <br />restricted deeds that are required as part of the Exemption subdivision <br />approval shall be submitted for recording, along with the Final Plat, to the <br />
