<br />INTERIM POLICY ON FAMILY SPLITS, NO IMPACT SUBDIVISIONS <br />AND <br />RESOURCE PRESERVATION PLANS <br />The Board of County Commissioners of Delta County, Colorado do adopt this <br />interim policy that provides for modifications to the submittal requirements <br />and approval procedures for certain types of subdivisions and minor <br />subdivisions. Specifically, this policy provides for modifications to the major <br />and minor subdivision regulations as follows: <br />I. FAMILY SPLIT SUBDIVISIONS <br />The{ioard of County Commissioners (BOCC) may modify the submittal <br />requirements for major and minor subdivisions when the sole purpose is to <br />convey the lots to a family member as defined in this policy. <br />A. Definitions <br />Family Member- For purposes of this Policy the term 'family member' shall <br />include fathers, mothers, husbands, wives, daughters, sons, brothers, sisters, <br />grandchildren and grandparents. Stepchildren are considered family <br />members when they are actually (defacto) members of the family. <br />Family Split- For purposes of this policy a family split is the division of land <br />where the newly created lots will be immediately transferred to a family <br />member(s). <br />B. Eligibility Criteria <br />To qualify for a Family Split Exemption the proposed land division must meet <br />the following criteria: <br />1. The number of lots created may not exceed the number of family <br />members as defined in this Policy. <br />2. The title to the new lots will be transferred to the family member(s), by <br />deed, concurrent with the recording of the Final Plat. The deed shall be <br />recorded, by the County staff, concurrently with the recording of the Final <br />Plat. <br />3. Lots may not be conveyed to anyone other than o fomily member of <br />the applicant (and spouse) for a period of at least 7 years. A deed <br />
