Informal conferences may be <br />held within sixty days after the last publication of the applicant's notice. <br />Adequacy Review: Upon finding an application Complete, we aze required to conduct an <br />initial Adequacy Review of the application during the subsequent sixty calendar days. This is <br />done to determine if the permit application meets all statutory, regulatory, and <br />scientific/technical requirements for application approval. Comments submitted to our office <br />regazding the application aze considered at this time. An estimate of the amount of reclamation <br />bond needed for the proposed operation may also be developed at this time. If we determine <br />that an application needs clarification or modification, we notify the applicant of this in what <br />we call an Adequacy Letter. Copies of changes to an application made during Adequacy <br />Review aze required to be posted with the public copy of the application. <br />Our law and Rules require us to propose a decision regarding a permit application within one- <br />hundred-and-twenty calendar days from the day an application is filed. It is the responsibility <br />of an applicant to submit responses to our Adequacy Letter in time for us to review those <br />responses by the one-hundred-and-twenty-calendar-day deadline. An applicant may need more <br />time beyond the one-hundred-and-twenty days to respond to our Adequacy Letter; in such a <br />case, the applicant can request an extension of the one-hundred-and-twenty day deadline. <br />Proposed Decision: Once an application meets all requirements of our law and Rules for <br />approval, we are required to issue a Proposed Decision to approve the application. Should the <br />application not meet all the requirements for approval, we may issue a Proposed Decision to <br />partially approve the application, to approve the application with conditions, or to deny the <br />application. A Proposed Decision approving, partially approving, or approving with conditions <br />a permit application will also contain the amount of reclamation bond required. The Proposed <br />Decision is sent to the applicant, to any commentors, and to the US Office of Surface Mining. <br />Public Notice of Proposed Decision: When we issue a Proposed Decision, we publish a <br />notice in a local paper once a week for two consecutive weeks. Comments regarding our <br />Proposed Decision, including requests for a Formal Public Hearing, may be submitted within <br />the thirty-calendar-day period following the first public notice publication. <br />Formal Public Hearing: Should a request for a Formal Public Hearing before the Colorado <br />Mined Land Reclamation Boazd regarding our Proposed Decision be submitted, the Board is <br />required to conduct the Formal Public Hearing within thirty calendaz days following receipt of <br />the request. The Boazd is required to notify all interested parties of the date, time, and location <br />of the Hearing, and is required to publish a notice of the Hearing in a local newspaper. At or <br />after the Hearing, the Board may decide to affirm, modify, or reverse our Proposed Decision. <br />The Boazd is required to render its decision at or within thirty calendaz days after the Hearing. <br />• Final Decision: If a request for a Formal Public Hearing regarding our Proposed Decision is <br />not submitted, our Proposed Decision becomes a Final Decision on the thirty-first day <br />following the first of our two public notices. If a Formal Public Hearing is held, the Final <br />Decision is made by the Boazd. <br />
