Berry, our Division's Coal Program Supervisor, <br />requesting information about the process of permitting coal mines in Colorado. Mr. Berry has asked <br />me to reply to your letter on his behalf. <br />A. Colorado Coal Mine Permitting Process <br />The process for permitting coal mines in Colorado is conducted primarily by our Division's Coal <br />Program. This process is described in the Colorado Surface Coal Mining and Reclamation Act (law) <br />and the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining (Rules), copies <br />of which I have enclosed. Generally, the process involves the following: <br />Completeness Review: Upon submittal of an a permit application to our office, we have ten <br />calendar days within which to review the application and determine whether all pertinent <br />information required by our law and Rules to be in the application has been provided. If certain <br />required information has not been submitted, we deem the application Incomplete, inform the <br />applicant of this missing information, and stop our review process until this information is <br />submitted. Once an application contains all required pertinent information for us to review it, <br />we deem the application Complete, or "filed". <br />Public Notice of Application Filing: Upon deeming an application Complete, we inform <br />certain local, state, and federal government agencies of our determination, and of their <br />opportunity to comment on the proposed operation. We additionally direct the applicant to <br />publish a notice in a local paper regarding the proposed operation. The applicant's notice is <br />required to be published once a week for four consecutive weeks. This notice is required to <br />contain, among other things, information pertaining to the applicant and the operation, and the <br />location of where a copy of the application will be available for local public review (usually a <br />county courthouse). Comments, objections, requests for informal conferences, and requests for <br />pertinent public hearings may be submitted within the thirty-day period following the last <br />publication of the applicant's notice.
