The Division is fully aware that the roads leading to this site have <br />been in place for a number of years, However, Blue Flame still must <br />address the specifications of Rules 4.03.1(3) and (4) as requested in <br />our earlier correspondence. <br />4.05 Hydrologic Balance <br />To meet the requirements of Rule 4.05.6(11)(c), the Division suggests <br />the attached document be executed on a quarterly basis with a copy <br />retained at the mine site and a copy submitted to the Division. <br />2. Will water be diverted into the underground workings? If so, the <br />requirements of Rule 4.05.16 must be addressed. <br />4.06 Topsoil <br />This section of the application should be modified since new areas will be <br />disturbed by the construction of the sediment pond and upland diversion <br />ditches. <br />4.08 Use of Explosives <br />1. Please provide a copy of the Division of Mines permit to use and store <br />explosives once Blue Flame has received the permit. <br />2. Rlue Flame needs to depict the location of the powder magazine(s) on <br />the appropriate map(s). <br />4.11 Coal Processing Waste <br />1. The Division agrees with Blue Flame's statement of no coal processing <br />on this site. The only "processing to be accomplished is screening and <br />crushing of coal on the mine bench". One by-product of this <br />"processing" will be coal fines. Blue Flame needs to address the <br />deposition of these coal fines both during mining operations and with <br />final reclamation. <br />2. The requirements of rule 4.1].4 pertaining to noncoal waste needs to be <br />addressed. <br />4.20 Subsidence Control <br />Prior to the Division being able to approve the subsidence plan, the <br />Division needs to review the response to Rule 2.05.6 concern 2. <br />
