-5- <br />2.05.3 Operations Plan - Permit Area <br />Concerns 1, 3, 5, 6, 7 and 8 of our March 3rd correspondence needs to <br />be addressed. <br />2. Blue Flame should address the deposition of underground development <br />waste as requested pursuant to 2.05.3(9). <br />3. To address the concerns raised pursuant to 2.05.3(4), Blue Flame should <br />include a discussion directing the reader to the appropriate other <br />sections of this application that address sediment ponds, diversions, <br />etc. <br />2,50.4 Reclamation Plan <br />1, Concern no. 2 of our March 3rd adequacy letter must be addressed prior <br />to the Division being able to approve retention of the access roads as <br />final reclamation. <br />2, Pursuant to Rule 4.05.2(1), it is necessary to retain the sediment pond <br />after regrading and seeding of this site until the requirements of Rule <br />4.05.2(2) have been met. The third paragraph on page 1 of this exhibit <br />must be amended to reflect these regulations. <br />3, The third paragraph of page 2 specifies that the disturbed areas will <br />be returned to the approximate original 3:1 slope. However, the next <br />paragraph on this same page addresses topsoiling of 2:1 slopes. Blue <br />Flame needs to amend this section to reflect the 3:1 slope during all <br />discussions. <br />4, Blue Flame should address the depth of topsoil to be returned over the <br />sediment pond area when this area is finally reclaimed. Since the <br />sediment pond will be located in a previously undistrubed level area, <br />the depth of topsoil replacement should be greater than on the 3:1 <br />slopes. <br />5, In response to concern 12 of our March 3rd letter, Blue Flame revised <br />the "Reclamation Time Tables" reflecting all reclamation activities to <br />occur in April and May. The standard practice of reclamation is to <br />perform all of the required activities prior to the period of greatest <br />precipitation. In this area, the greatest precipitation on this <br />north-facing slope would occur during the winter months. Therefore, <br />Blue Flame should revise the table to reflect reclamation occurring in <br />September and October. <br />6, 81ue Flame needs to address concern 15 of our March 3rd letter. <br />7, Page 6 discusses drill holes on this site. It is our understanding <br />that there are no drill holes on this site. If this is incorrect, Blue <br />Flame needs to submit documentation as to where these holes are located <br />
